EzyParty Rentals Terms and Conditions
CUSTOMER PICKUP & DROP OFF ONLY. EzyParty Rentals is CURRENT NOT DOING DELIVERY. (Customer must pick up n drop off the items same day or next day) depending on your booking date and time we maybe can do the delivery for you. We do charge a fee base on location and distances. These Terms and Conditions ("Agreement") govern the use of services provided by EzyParty Rentals ("we," "us," "our") to the client ("you," "your"). By placing an order with EzyParty Rentals, you agree to abide by the following terms and conditions.
1. Rental Agreement
1.1 Rental Period: The rental period begins when the items are delivered and ends when they are returned to EzyParty Rentals. The standard rental period is 24 hours unless otherwise agreed upon.
1.2 Ownership: All rental items remain the property of EzyParty Rentals. You are responsible for the care, custody, and control of the rental items during the rental period.
1.3 Rental Fees: Rental fees are based on the agreed-upon rental period. Extended rental periods are available for an additional fee.
2. Reservations and Payment
2.1 Booking: A reservation is confirmed only when a non-refundable deposit of 25% of the total rental cost is received. The remaining balance is due 3 days before the event.
2.2 Payment Methods: We accept payments via Zelle (678-499-3419), cashapp: $ncwatson19, Venmo: @adatees (3419), and Cash. All payments must be made in full before the delivery of rental items.
2.3 Price Changes: Prices are subject to change without notice. However, confirmed reservations will not be affected by price changes.
3. Cancellations
3.1 Client Cancellation: If you cancel more than 14 days before the event, you will receive a refund of payments made, minus the non-refundable deposit. Cancellations within 14 days of the event will forfeit all payments.
3.2 EzyParty Rentals Cancellation: We reserve the right to cancel any reservation due to unforeseen circumstances. In such cases, a full refund, including the deposit, will be issued.
4. Delivery and Pickup
4.1 Delivery: We deliver to locations within our service area, which includes Lawrenceville, GA, and surrounding communities. Additional fees may apply for deliveries outside this area.
4.2 Access: The client must ensure that the delivery site is accessible and ready for setup. Any delays caused by lack of access may incur additional charges.
4.3 Pickup: Rental items must be ready for pickup at the agreed-upon time. If items are not ready, additional fees may apply.
5. Client Responsibilities
5.1 Care of Rental Items: You are responsible for the proper care and use of all rental items. Items should be returned in the same condition as they were delivered.
5.2 Damage or Loss: You are liable for any damage, loss, or theft of rental items during the rental period. Charges for repair or replacement will apply.
5.3 Inspection: You should inspect all rental items upon delivery. Any issues should be reported immediately to EzyParty Rentals. Failure to report any issues within 24 hours will be deemed as acceptance of the items in good condition.
6. Usage and Safety
6.1 Proper Use: All rental items must be used for their intended purposes only. You are responsible for ensuring that items are used safely and appropriately.
6.2 Supervision: Adult supervision is required for all items intended for children's use, such as inflatables. EzyParty Rentals is not liable for any injuries or accidents resulting from improper use or lack of supervision.
6.3 Prohibited Activities: You agree not to use rental items for any illegal activities or in a manner that could cause damage or injury.
7. Liability and Indemnity
7.1 Limitation of Liability: EzyParty Rentals is not liable for any direct, indirect, incidental, or consequential damages arising from the use of rental items. Your sole remedy for any breach of this Agreement by us is a refund of the rental fee paid.
7.2 Indemnification: You agree to indemnify and hold harmless EzyParty Rentals, its employees, agents, and affiliates from any claims, liabilities, damages, or expenses arising out of your use of the rental items.
8. Force Majeure
EzyParty Rentals shall not be liable for any delays or failure to perform due to circumstances beyond our control, including but not limited to acts of God, natural disasters, strikes, war, terrorism, or governmental actions.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Georgia. Any disputes arising from this Agreement shall be resolved in the courts of Gwinnett County, Georgia.
10. Entire Agreement
This Agreement constitutes the entire understanding between you and EzyParty Rentals regarding the subject matter hereof and supersedes all prior agreements, understandings, and negotiations, whether written or oral.
11. Amendments
EzyParty Rentals reserves the right to modify these Terms and Conditions at any time. Any changes will be communicated to you, and your continued use of our services constitutes acceptance of the updated terms.
